Charges dropped against former Penn St. running back

BELLEFONTE, Pa. – Rape charges, and all others, were dropped Friday against former Penn State running back Austin Scott.

The decision comes after the state Superior Court ruled earlier in the day that jurors could hear testimony about the alleged victim's involvement in a separate sexual assault case in 2003. The defendant in that case was acquitted.

The Centre County district attorney's office says it withdrew the charges because it could no longer meet the burden of proof.

Defense attorney John Karoly said Scott was happy when he heard the news but wonders why the case started in the first place.

The 23-year-old player from Allentown was suspended by Penn State coach Joe Paterno on Oct. 5, citing a violation of team rules. Police charged Scott a week later.
